OMAHA, Neb. - OMAHA, Neb. (AP) — Federal regulators say an ethanol plant near Sutherland has violated pollution rules by emitting too much carbon dioxide and failing to obtain proper permits for an expansion project.

The Environmental Protection Agency filed a lawsuit against Midwest Renewable Energy LLC seeking civil penalties and fines.

Company officials declined to comment because they had not seen the lawsuit.

The EPA says the company exceeded its limits for carbon dioxide emissions from the time the plant opened in 2004 to March 2007, when a faulty piece of equipment was fixed. And regulators say the company failed to test and document some of its pollution-control measures.

The lawsuit also says the company failed to update its risk-management plan.
