Modena woman assaulted husband while he slept, cops say

An Ulster County woman was charged after attacking her sleeping husband Tuesday with the handle of a folding knife, police said.

Janet E. Devine, 50, of Modena, was charged with second-degree assault and criminal contempt, felonies, in the attack on her husband Gary J. Devine, 48, the Ulster County Sheriff's Department said in a statement Thursday.

A deputy went at 11:45 Tuesday night to the Devines' Plate Road apartment on a report of a domestic fight, police said. Janet Devine had hit her husband on the head with the knife handle while he slept, police said.

In the course of the fight, Gary Devine broke a door in the apartment and Janet Devine got a cut on her hand, police said.

Gary Devine was treated by the Plattekill Rescue Squad on the scene. Janet Devine was brought to Saint Francis Hospital in the Town of Poughkeepsie for treatment of her hand and released.

Police discovered Gary Devine had an order of protection against Janet Devine, leading to her criminal contempt charge. It was not immediately clear why the Devines were in their home together if there was an order of protection against Janet Devine.

Gary Devine was charged with misdemeanor criminal mischief for breaking the door.

Gary Devine was issued an appearance ticket to appear in Plattekill Town Court on Feb. 8. Janet Devine was arraigned Wednesday in the town court and sent to the Ulster County jail in lieu of $1,000 bail. She is to return to court Friday.

A call to the Ulster Sheriff's Department was not immediately returned Thursday, and attorney information was not immediately available for either Gary or Janet Devine.
