Glen Cove murder suspect appears in court

The Glen Cove man accused of killing and dismembering his neighbor appeared before a judge today, as lawyers discussed whether he will be ordered to hand a DNA sample over to prosecutors.

Evan Marshall, 31, looked sullen and dishevelled in a grey suit and a open-collared blue dress shirt.

Prosecutors requested a sample of Marshall's DNA last week. Marshall's lawyer, William Keahon, of Islandia, will have until tomorrow to submit papers responding to that request.

However, a spokesman for Nassau District Attorney Kathleen Rice said Marshall's case could be presented to a grand jury at any time, possibly before a DNA sample is returned.

Marshall is charged with second-degree murder in the slaying of Denice Fox, 57, a retired teacher who lived two doors away from Marshall and his mother. He is being held in Nassau County jail in East Meadow.
