MONTCLAIR - A gay couple from Montlclair whose engagement photo was used in an anti-gay political mailer is suing the group that lifted their picture.

Tom Privitere and Brian Edwards, along with their photographer Kristina Hill, are taking on the Virginia-based group Public Advocate of the U.S.

They claim the organization stole their engagement photo from an online blog and then used it in a campaign mailer attacking a Colorado senator who supports gay marriage.

The photo shows the couple holding hands and kissing with a New York City skyline as a backdrop.

The photo was copyrighted by Hill. She says she never gave permission for it to be used in the mailers, which all three describe as "hateful."

The Southern Poverty Law Center filed the suit yesterday in Colorado on the couple's behalf.
