Three people were injured at a Times Square construction site when a 15-foot fence came crashing down in high winds and trapped the victims underneath. Two women and a man were injured after they were struck by a 15-foot fence that collapsed in high winds. According to a Nov. 1 report on NJ Newsday, the victims were all pinned under the collapsed wall before being pulled out of the debris by heroic bystanders. All three victims were transported to an area hospital with non-life-threatening injuries, the report said.
The plywood wall, was covering the entrance of the Wasabi Sushi restaurant, which is under construction, the article stated. Texas-based company Einstein Construction, which has been refurbishing the restaurant, has been issued a violation order and instructed to stop work at the site. The New York City Department of Buildings is investigating the cause of the incident, according to the article.
New York personal injury lawyer Kenneth A. Wilhelm said it is fortunate the victims suffered non-life-threatening injuries and also that no one else was injured. "This incident happened in an area that is always crowded with tourists, pedestrians and other visitors. Such incidents usually result in devastating injuries and could also cause potential fatalities."
Wilhelm said it is the job of construction companies and general contractors to ensure that all structures within a construction site are safe and secure. "Whether these structures injure workers on the site or bystanders, the at-fault party can be held financially liable for the injuries and damages."
Injured victims of these types of accidents are usually entitled to compensation including medical expenses, lost wages and benefits, hospitalization, past and future pain and suffering, Wilhelm says. "It is important that victims of such accidents obtain legal counsel so that their rights are protected and that they obtain the compensation they rightfully deserve." In one of our construction accident cases (Index Number: 113585/2003, Supreme Court, New York County) our law firm recovered $3,375,576 for the injured worker.
