Charges against a Montauk man arrested Saturday after a serious accident in East Hampton Village were upgraded Wednesday after village police said toxicology tests found he was “in excess of three times the legal limit” for driving while intoxicated at the time of the crash.
Kyle Rosko, 33, charged with driving while intoxicated after the Saturday evening crash on Further Lane, has been charged with aggravated DWI, police said. He is scheduled for arraignment Thursday in East Hampton Town Justice Court.
Police said that Rosko was driving east on Further Lane at “a high rate of speed” when he lost control of his car at 8:09 p.m. — and the vehicle left the road, became airborne and rolled onto its roof on the Maidstone Golf Course.
Rosko was airlifted to Stony Brook University Hospital. His injuries were not immediately known.
Police, citing procedure, declined to release the specific blood alcohol content for Rosko, stating only that results from a blood sample processed at the Suffolk County Crime Lab came back “in excess of three times the legal limit,” which is 0.08 percent.
