Cops: Driver won't be charged in bicyclist fatal

The driver who hit and killed a bicyclist in Flanders on Friday will not be charged, Southampton Town police said Monday.

Frank Austria, 72, whose identity was released Monday, was not injured in the accident that killed Robert L. Nelson, 50, of Flanders, police said.

Austria was driving his Grand Cherokee north on Flanders Road when Nelson pedaled into the traffic lane near Cypress Avenue about 7:45 p.m., police said.

Nelson was treated at the scene by a Northampton Volunteer Ambulance, which also took Nelson to Peconic Bay Medical Center in Riverhead, where he was pronounced dead, police said.

Austria had remained at the scene, police said.
