Police: Drunken driver ignores Babylon accident detour

State Police troopers in the middle of an accident reconstruction following a fatal crash on Ocean Parkway in Babylon Monday night were stunned when a drunken driver plowed through their detour, officials said Wednesday.

A Greenlawn man, Andrew Wagner, 45, of 5 Aster St., was arrested and charged with driving while intoxicated and vehicle and traffic law violations, State Police spokesman Frank Bandiero said.

Police were conducting an investigation at the scene of the fatal crash, which had happened about five hours earlier. In that accident, Jeffrey McGuire, 33, of Wading River, died after he exited his vehicle following a collision and was struck by another car. The crash was near Oak Beach.

Wagner drove through a detour on the eastbound road, Bandiero said. He was arrested at about 11:10 p.m. Monday.

Troopers who stopped him "detected a strong odor of alcohol coming from the driver's breath," according to State Police.

Police said Wagner's blood alcohol content was .10.

Wagner is scheduled to appear in First District Court in Central Islip on Jan. 28, police said.
