Investigators from State Attorney General Eric Schneiderman’s office are reviewing surveillance video that shows a 37-year-old man being fatally shot by an off-duty NYPD officer just moments after exiting his car — footage that appears to conflict with an initial account given by police, officials said.
The video, recorded early Monday from a Brooklyn building and obtained by Schneiderman’s office earlier this week, shows Officer Wayne Isaacs, also 37, of Brooklyn, who had just gotten off duty, shooting Delrawn Small as he approached the driver’s side window of Isaacs’ 2002 Nissan Altima at Atlantic Avenue and Bradford Street in East New York, officials said.
Police have said Small apparently believed the officer had cut him off while driving, police said. He got out of his 2016 Kia, in which his girlfriend and three children remained, approached Isaacs’ car, and began punching the officer in the head through the car window, police have said.
But the video being reviewed by the attorney general’s office shows Small being shot just after he reaches the officer’s car door, officials said. He staggers away, mortally wounded, and collapses between two nearby vehicles.
Police said Isaacs was taken to Jamaica Hospital Medical Center with bruises to his head after the shooting. Neither Isaacs’ nor Small’s family could immediately be reached for comment Saturday.
“As Special Prosecutor, I am committed to conducting a full, fair and independent investigation of this tragedy, and will follow the facts and evidence — including this video evidence — wherever they lead,” Schneiderman said in a statement. “As our investigation continues, we urge any witnesses who may have additional information to come forward to our office. My heart goes out to the Small family during this painful period.”
Schneiderman’s special investigation unit, empowered last year through an executive order by Gov. Andrew M. Cuomo, looks into cases in which unarmed civilians are killed by police.
