Electrician to be retried after mistrial in parking space punch case

Prosecutors said yesterday they will retry a electrician for allegedly punching a young woman during a East Village parking space dispute and leaving her brain damaged.

A Manhattan judge declared a mistrial after a deadlocked jury said it could not come to a decision on the guilt of Oscar Fuller, 35, of Jamaica, Queens.

Three jurors told reporters outside the courtroom that one juror did not feel that the evidence proved that Fuller intended to harm Lana Rosas, 25, from the Bronx, when he punched her with such force she went hurtling into the pavement and cracked open her head. Rosas was in a coma for nine days after the Feb. 25 incident, hospitalized for months afterward, and is now forced to wear a helmet to protect her fragile skull.

Fuller, who did not testify but whose lawyer contended that he hit the petite woman in self defense, could face seven years if convicted.

Fuller is due back in court on Jan. 5.
