It was a “night of horror” for a 27-year-old woman who was raped in her East Village apartment in 2008 by an NYPD officer while his partner watched, prosecutors told jurors yesterday.
Officers Kenneth Moreno and Franklin Mata responded to a 911 call from a taxi driver whose fare was too drunk to exit the cab. Prosecutors said Moreno raped the victim on her bed.
Moreno’s attorney, Joseph Tacopina, told Manhattan jurors that his client had “physical contact” with the woman — but not sex — after she “became flirtatious.”
The victim secretly taped a conversation with Moreno in which he said he wore a condom during the incident, officials said.
The officers face up to 25 years in prison.
