Texas dad not charged in deadly beating of daughter's alleged molester

A Texas man accused of beating to death the alleged molester of his 5-year-old daughter will not be prosecuted, according to published reports.

The unidentified man, 23, will not face any charges in the death of Jesus Mora Flores after a grand jury concluded Tuesday that he had a right to use deadly force to keep his daughter safe, reports said.

"The substantial amount of evidence showed that the witness statements and the father's statement and what the father had observed was in fact what had happened that day," Lavaca County District Attorney Heather McMinn told reporters.

On June 9, the father reportedly heard the screams of his daughter coming from the area near his barn on his property in Lavaca County.

When he arrived, the man allegedly saw Flores, 47, molesting his young daughter, according to reports.

After pulling Flores off her, the father began punching him.

Minutes later, the father called 911, and in a released tape of the call he can be heard screaming for help.

"Come on! This guy is going to die on me!" he said, in the 911 call which the Associated Press obtained.

"I don't know what to do!"

A statement from the county sheriff said that when authorities arrived to the secluded ranch, they found Flores with his underwear and pants down. Both the child's grandfather and aunt attempted to resuscitate Flores before paramedics arrived, according to the Los Angeles Times.

An autopsy by the Travis County Medical Examiner released to LA Times said Flores died of "blunt force head and neck injury." The death was officially ruled a homicide. The father was never arrested in connection with the death.

"He's a peaceable soul," V'Anne Huser, the father's lawyer, told reporters Tuesday. "He had no intention to kill anybody that day."

Huser added, after the indictment became public: "In our opinion, today, the story is over."

Huser didn't return a request for comment.
