CA Inc. files patent lawsuit against San Francisco software developer

CA Inc., an Islandia-based software maker and one of the largest public companies on Long Island, said Monday it has filed a patent infringement lawsuit against San Francisco-based software developer New Relic.
The suit, which was filed in federal court in Brooklyn says New Relic offers an application performance management (APM) service that infringes on three software patents held by CA. APM technology is used to monitor information systems and applications, and is used by businesses to ensure any technology-based services run smoothly.
Lew Cirne, the founder and chief executive of New Relic, declined to comment. "We have not seen any details of the lawsuit and cannot comment at this time," he said. "I'm confident New Relic has conducted business with the utmost integrity."
Cirne is CA's former chief technology officer; he joined CA when the APM company he founded, Wily Technology, was acquired in 2006. He is listed as a co-inventor on two of the three patents in the lawsuit. Cirne left CA in 2007 and began New Relic in 2008, according to the lawsuit.
In addition to an order to restrain New Relic from offering services that infringe on the patents, CA is seeking damages for lost profits and legal fees.
