  1. WHAT INFORMATION DOES THIS PRIVACY POLICY COVER?

  2. SOURCES OF PERSONAL INFORMATION
    • Directly from you. For example, during account registration from forms you complete, subscriptions you purchase or comments you provide on our services.
    • Indirectly from you. For example, from observing your actions on our services including as you navigate through and interact with our websites and services. We may compile statistical information concerning your usage of the websites through analytics services, such as those provided by Google Analytics, Adobe Analytics, and similar providers.     Information that you provide to us: We and our service providers collect information that you provide when you use our services. For example, to access certain parts of our services, you may have to register or subscribe for an account.     Passive data collection: Like most companies that offer services online, we and our service providers may automatically collect certain technical information from your computer, tablet or mobile device when you use our services or interact with us. The information we may collect includes but is not limited to:

    We, our service providers, and other third parties with whom we do business may collect information about you from publicly available sources (e.g., social media platforms) and commercially available resources. We may combine that information with the information described above and will handle the combined information as described in this Privacy Policy.

    Information we collect across devices and applications. In order to improve the personalization of the content, features, and advertising, and provide you with a seamless experience across the devices you use to access the services, we or our service providers may use your personal information (e.g., log-in credentials, IP addresses, hashed email addresses, and unique mobile device identifiers) to locate or attempt to locate unique users across different browsers or devices.

    Location Information - Our mobile applications may collect precise information about the location of your mobile device via your device's GPS or cellular connectivity, but only with your express consent. Once you have consented to the collection of such precise location information via your mobile device, you may adjust this consent by managing your Location Services preferences through the settings of your mobile device and disable the collection of such a data. Precise geolocation is considered a type of sensitive personal information. We may also be able to infer your location from other information that you provide or information that we collect passively, such as the known locations of nearby Wi-Fi networks. Ads on our websites and apps may be targeted based on the approximate location and are never targeted based on your precise geolocation. For example, your IP address indicates that you are from a certain US State and that you live in a certain city or region. As a result, our services may be personalized with information and advertisements related to that particular US State, city or region.

    We may combine or aggregate any of the information we collect from our services and elsewhere for any of these purposes.

    A few of our vendors use pseudonymized information, including a hashed version of personal information (such as email or phone number), that they receive from us to provide products and services to us and their other customers. "Pseudonymize" means the processing of personal information in a manner that renders the personal information no longer attributable to a specific consumer without the use of additional information. Therefore, it is possible that your personal information is being used in pseudonymized form by these vendors, who have taken technical and organizational measures to ensure that your personal information is not attributed back to you. For example, when you use our websites and enter your email address on our websites (either to log in, or to sign up for a newsletter, or similar), we may share with LiveRamp and its group companies information that we collect from you, such as your email (in hashed, pseudonymous form), IP address, or information about your browser or operating system, with any of the following, acting as service provider (as applicable and defined in the CCPA) and/or "joint controllers" (as applicable and defined in the GDPR).

    LiveRamp uses this information to create an online identification code that we may store in our first-party cookie advertising for our use in online, in-app, and cross-channel. This may be shared with advertising companies to enable interest-based and targeted advertising. LiveRamp uses this information to create an online identification code for the purpose of recognizing you on your devices. This code does not contain any of your directly identifiable personal information and will not be used by LiveRamp to re-identify you.

  5. HOW WE DISCLOSE AND SHARE THE INFORMATION WE COLLECT

    We do not share your credit card information or other financial information with third parties for their marketing purposes or other independent use. When we share information with third parties for processing credit card or other payments, we require those third parties to comply with applicable Payment Card Industry standards.

    We may share Aggregated Information with third parties that provide content and services for us. We may also share Aggregated Information with advertisers and others so that they can better understand our audience. For example, we might disclose the gender, age, or geographical breakdown of our user base.

    You should know that when you voluntarily disclose personal information publicly on our services, that information may be collected and used by others and you may receive unsolicited communications from other people. Public activities may be included in our RSS feeds, APIs, and other distribution formats. As a result, your public activities may appear on other websites, blogs, or feeds.     Some of our services and communications may contain tiny electronic images known as web beacons.   9. CHILDREN'S PRIVACY

    Newsday's services are not intended for use by children under the age of 13. In addition, we do not knowingly collect information from children under the age of 13, although certain third party sites that we link to may do so. These third party sites have their own terms of use and privacy policies and we encourage parents and legal guardians to monitor their children's Internet usage and to help enforce our Privacy Policy by instructing their children to never provide information on our websites without their permission.

    Involvement of parents. In accordance with the provisions of the Children's Online Privacy Act, if we do begin collecting any personal information or data from children under the age of 13, we will notify parents first, and will seek parental or guardian consent to collect, use and/or disclose certain personal information from children under the age of 13.       If you have elected to receive text messages, you can opt out of text alerts any time by replying "STOP" or any alternative keyword. We complete any opt out request as fast as we can. If you opt out from one of our text message programs, you may continue to receive text messages from Newsday through any other programs you have joined (e.g., editorial text alerts, sweepstakes, etc.) until you separately unsubscribe from those programs. THE OPT OUT REQUESTS WON'T PROHIBIT US FROM SENDING YOU IMPORTANT NONMARKETING COMMUNICATIONS. Text messaging originator opt in data is shared only with our service providers.     While we strive to maintain reasonable administrative, technical, and physical safeguards to protect your information, no information system can be 100% secure. We cannot guarantee the absolute security of your information. Moreover, we cannot be responsible for information that you transmit over networks that we do not control or information that you choose to publicly disclose.     We make reasonable efforts to secure the account information pages and other registration locations for our services, such that they can be accessed only by our authorized personnel or by logging in with your username and password.

  12. HOW LONG WE RETAIN YOUR INFORMATION

    We retain your personal information for as long as necessary, including to provide you the services and while you have an open account with us. We may retain your personal information for longer if it is necessary to comply with our legal or reporting obligations, resolve disputes, collect fees, etc. or as permitted or required by applicable law.

        After we receive and confirm your verifiable consumer request, we will delete your personal information from our records within the time period required by the CCPA, unless an exception applies.

      4. Right to Opt Out of Having Your Information Sold or Shared. You have the right, subject to certain limitations, to opt out of having your personal information sold or shared. Under the CCPA, a "sale" is the disclosure of your personal information for monetary or other valuable consideration. "Sharing" means disclosing your personal information to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration.       6. Right to Non-Discrimination for the Exercise of Your Privacy Rights. We will not discriminate against you for exercising any of your rights under the CCPA, as described above. This includes but is not limited to: (i) denying good or services to you; (ii) charging you different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties; (iii) providing a different level or quality of goods or services; or (iv) suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services. It also includes an employee's, applicant's, or independent contractor's right not to be retaliated against for the exercise of their CCPA rights.

        However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information's value and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

        We currently do not offer any financial incentive, benefit, or price differences in return for the disclosure, deletion, sale or sharing of personal information. However, in general, our business model is based on providing a certain amount of free content to readers, after which we may require that additional content access must be paid for.

    3. Exercising Your Rights

      To exercise the right to know, correct, or delete, as described above, please submit a verifiable consumer request through this web form or by emailing privacy@newsday.com. You may make a verifiable consumer request for access or data portability only twice within a 12-month period.

      We reserve the right to only respond to verifiable consumer requests to know, delete, or correct. A verifiable consumer request is one made by any individual who is:

    4. Response Timing and Format

      We use good faith efforts to respond to a verifiable consumer request within forty-five (45) days after its receipt. If we need more time (up to 90 days), we will inform you of the reason and the needed extension period in writing.

      Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. If we cannot comply with any portion of a request, the response we provide will also explain why, if applicable.

      We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

      Authorized Agent. You may authorize a natural person or a business (the "Agent") to act on your behalf with respect to the rights under the California privacy law. When you submit a request to know, correct, or delete, the Agent must provide proof that you gave the Agent signed permission to submit the request, and you either must (i) verify you own identity with the business or (ii) directly confirm with us that you provide permission to the Agent. However, these steps are not required when you have provided the authorized agent with power of attorney pursuant to Probate Code sections 4000 to 4465. We reserve the right to deny requests from persons or businesses claiming to be authorized agents that do not submit sufficient proof of their authorization.
