Wolf and Pravato, P.A's Alleged Negligence Case Results in $315,000 Settlement

Another win for Wolf and Pravato. On March 18, 2014 at Restaurant Depot located at 1470 West Copans Road, Pompano Beach, Florida, Mrs. Edrica Miller was shopping when she slipped and fell allegedly due to a large puddle of water on the floor, which was allegedly leaking from the roof. Under Florida law, the business owed two duties of care to an invitee on its premise: 1) to warn the invitee of dangerous conditions on its property, and 2) to ensure that its property is maintained in a safe condition. In this case, Mrs. Miller alleged that Restaurant Depot breached its duty of care by failing to maintain its property (including its roof) in a safe condition, by allowing this dangerous condition to remain on the floor, and by failing to post any warnings of the dangerous condition on the floor.
After Mrs. Miller’s treatment concluded, Richard Pravato (personal injury lawyer), senior trial attorney at Wolf & Pravato, PA, made a demand to resolve Mrs. Miller’s case with the defendant, Restaurant Depot. Restaurant Depot denied liability, alleged there were in fact caution signs in place and that Mrs. Miller was wearing flip flops in violation of the store’s policy. Restaurant Depot offered $5,000 to settle the case.
Attorney Richard Pravato filed a law suit in Broward County, Florida on behalf of Mrs. Miller. After depositions, experts and mediation, the case was resolved. Defendant Restaurant Depot agreed to settle the case with Mrs. Miller for $315,000 in 2017.
