A rally in energy stocks Tuesday wasn't enough to lift the broader market, leaving only the Dow Jones industrial average with gains at the closing bell.

At the close on Wall Street, The Dow was up 13.8 points, nearly 0.1 percent, at 16,790.2. The Standard & Poor's 500 index had slipped 7.1 points, about 0.4 percent, to 1,980, and the Nasdaq composite fell nearly 33 points, about 0.7 percent, to 4,748.4.

About the same time, U.S. benchmark crude rose $2.42, about 5.2 percent, to $48.68 a barrel on the New York Mercantile Exchange. The Nov. 15 contract is up for a second day.

Chevron, ConocoPhillips and other energy companies rose sharply Tuesday as the price of crude oil jumped.

DuPont soared 8 percent after its embattled CEO said she would retire.

Pharmaceutical companies had another tumble. Investors are worried about pushback from government and consumers over the industry's drug pricing practices.
