Kim Kardashian filed a lawsuit Wednesday against the apparel retailer Old Navy and its parent company, The Gap, alleging that Old Navy's "Super C-U-T-E" commercial infringes on her "name, likeness, identity and persona" by using a look-alike.

"Celebrities have the exclusive right to control the use of their likeness and identity, and to choose the products they endorse," her attorney, Gary A. Hecker, told E! News.

Melissa Molinaro, who dances and lip syncs with the pop group The Audio Threadz in the spot, showed E! a casting call that never mentioned Kardashian, but wanted someone reminiscent of Prince, David Bowie and Madonna.

However, Old Navy tweeted on February 24, "Breaking News! @CBSNEWS reports that Old Navy's Super CUTE star looks like @kimkardashian. #LOL. What do you think?" Old Navy told E!, "We have not seen any legal filing/received any such lawsuit."
