A Seaford man was arrested and charged with boating while intoxicated Sunday after he reported two passengers overboard in the Atlantic Ocean one mile off Jones Beach, Nassau County police said.

Police said the boat operator, Anthony J. Marmo, 36, of 2292 Oakdale Lane, had “traveled far enough” after the incident that by the time he realized what had happened the two men were “out of sight.” Fortunately for the two passengers, lifeguards at Jones Beach saw them in the water -- and took a rowboat out to save them. Neither was injured.

Police said the first man, identified only as a 37-year-old, fell off the back of the 23-foot Trophy boat just before 6 p.m. and that the second man, a 32-year-old, jumped into the ocean after him. But it wasn't until a bit later that Marmo realized the men were gone, police said. He then called 911 to report the men overboard.

After being fished from the Atlantic, the two men were taken to Nassau University Medical Center in East Meadow for observation and evaluation, police said.

Marmo was charged with BWI and is scheduled for arraignment on Monday in First District Court in Hempstead, police said.
