DA: Man guilty in sex attack on teen in Southampton

A Hamptons Bay man faces a maximum sentence of 25 years after he was convicted Wednesday of threatening a teenager with a bat, sexually assaulting her, and burglarizing a Southampton Village estate, Suffolk prosecutors said.
“This was a vicious crime and the defendant must be sentenced to the maximum prison term the law allows,” District Attorney Thomas Spota said in a statement.
A jury found Marvin Siciliano-Nunez, 20, guilty of first- and second-degree burglary, first-degree criminal sexual act, first-degree attempted rape and two counts of criminal obstruction of breathing, according to a news release from Spota’s office.
The defendant was acquitted of two counts of burglary as a sexually motivated felony and one count of second-degree burglary, the release said.
“Besides being disappointed with the verdict, we’re obviously going to appeal,” said David Geller, the attorney with the Legal Aid Society of Suffolk County who represented Siciliano-Nunez.
Prosecutors said that on the morning of Aug. 5, 2016, Siciliano-Nunez stole a skateboard, a phone and some jewelry before forcing a young woman, then 19, to perform oral sex while threatening her with a bat.
He was apprehended after a foot chase by Southampton Village police near the crime scene, according to prosecutors.
Sentencing was set for Aug. 2 by State Supreme Court Justice Peter Mayer, the news release said.
