NYPD says East Hampton man charged in fatal hit and run in Queens on New Year's Day

An East Hampton man who allegedly drove off after striking and killing one pedestrian and seriously injuring a second in Queens, was arrested and charged by the NYPD on Thursday, seven months after the New Year's Day crash.

In an updated news release late Thursday, the NYPD identified the driver as Jonnathan Barbecho, 31. He is accused in connection with the Jan. 1 death of a Queens man, identified by the NYPD in the same updated release as Darwin Adrian Malan Cargua, 37.

About 4:07 a.m. on Jan. 1, near 102 Street and 37 Avenue in Flushing, Queens, a white SUV heading south toward 37 Avenue struck the two male pedestrians as they crossed 102nd, according to the release. Malan Cargua, identified earlier as "Pedestrian #1," "was thrown into a parked and unattended 2021 Honda Pilot and became pinned underneath the vehicle,"

He was pronounced dead at the scene.

The other pedestrian, 24, "was thrown onto the roadway" and transported to NYC Health + Hospitals/Elmhurst in critical condition, the police said.

The SUV fled the scene following the crash. The NYPD did not immediately release additional information on the investigation, including what led them to arrest Barbecho seven months after the crash.

He faces manslaughter, vehicular manslaughter, two counts of assault, aggravated vehicular homicide, vehicular assault, leaving the scene of an accident resulting in death, aggravated unlicensed operation, leaving the scene of an accident with injury, registration suspended, operating motor vehicle with blood alcohol content .08 of 1%, driving while intoxicated, reckless driving, aggravated unlicensed operation, aggravated unlicensed operation with mandatory suspension, operating an unregistered vehicle, failure to exercise due care and imprudent speed.

Barbecho pleaded not guilty Thursday to all counts before Supreme Court Justice Gary Francis Miret at Queens Supreme Criminal Court, according to court documents. Miret ordered him held without bail. The defense attorney assigned to represent Barbecho at his arraignment could not be immediately reached late Thursday.
