A Stony Brook man accused of shooting his housemate with a crossbow was ordered Wednesday by a Suffolk County judge to stay away and not interact with the housemate and his family for a year.
Bail for Xiaonan Sun, 36, was set at $50,000 cash, $100,000 bond or $150,000 partially secured by 10%.
Suffolk County District Judge Rosann Orlando also ordered Sun to surrender any firearms and said he would only be permitted to go to the address of James Nicosia, the alleged victim, once and in the company of Suffolk County police.
Sun was arrested after Suffolk police said he shot Nicosia with a crossbow at their home on Hallock Road Tuesday night.
He was charged with second-degree assault and held overnight at the Sixth Precinct, police said.
Police said Nicosia was talking to the landlord — Sun's mother — when Sun shot Nicosia with a crossbow about 6:55 p.m. Nicosia, 41, was taken to Stony Brook University Hospital in serious but stable condition, police said.
The motive for the shooting remains unknown and the incident is under investigation, police said.
Sun, through his attorney Michael S. Ross, entered a plea of "general denial" at an arraignment on a class D felony held virtually before Orlando on Wednesday.
Prosecutors said that Sun was the alleged victim’s landlord but Ross disputed this, stating that Sun was the complaining witness' former landlord and the alleged victim had moved two weeks ago.
Prosecutors had sought higher bail, summarizing a statement they said Sun had made that he had pointed his compound bow at the alleged victim, aiming at this nonvital areas before firing an arrow. The alleged victim required immediate surgery, prosecutors said.
Ross argued that the prosecution’s request for higher bail was excessive because Sun had no prior criminal record.
Orlando set Sun’s next appearance date for Monday.
