A Wyandanch man was sentenced to 9 years in prison for selling fentanyl and crack cocaine to a woman who later died from an overdose, Suffolk County District Attorney Ray Tierney said Thursday in a news release.

Justin Llewellyn, 35, pleaded guilty in March to third-degree criminal sale of a controlled substance and fourth-degree conspiracy for selling the drugs to Yasmine DeLeon, 25, of Ronkonkoma. She had a fatal overdose in November 2022 in a Ronkonkoma hotel.

Llewellyn was one of 21 defendants indicted last April following a long-term narcotics and gun trafficking investigation, the release said.

Tierney said in the release that under current New York State law, prosecutors can only charge and seek penalties for defendants selling drugs, with no additional charges or penalties if the sale leads to death.

“This must change,” Tierney said. “I hope that our legislators do something to help stop the epidemic of opioid overdoses that we are seeing across New York State.”

He noted Chelsey’s Law, which is pending before the legislature, would allow prosecutors to charge drug dealers with manslaughter where there are reasonable grounds to know that the substance they are selling will cause death.

According to court documents and Llewellyn’s admissions, on Nov. 13, 2022, at about 9 p.m., he sold fentanyl and crack cocaine to DeLeon and another person at a Ronkonkoma hotel. The next morning, DeLeon was unresponsive. Llewellyn entered the room and administered Narcan to DeLeon, which had no effect, the release said.

Law enforcement was unable to resuscitate DeLeon and she was pronounced dead, the release said.

Llewellyn was arrested at the scene and found in possession of drugs including fentanyl, drug paraphernalia and multiple doses of unused Narcan.

When he was arrested, Llewellyn was awaiting sentencing on a 2021 drug conviction.

Llewellyn will have 3 years of post-release supervision after his 9-year sentence.
