A Calverton man who claimed he fired a shotgun at a burglar merely to scare him off is facing an assault charge, Riverhead police said.
Donald Cheshire, 69, initially told authorities he fired a warning shot at a man who was breaking into his River Road shed for the second time, police said.
Police said an investigation later determined that the burglar had been shot in the May 28 incident.
Cheshire was arrested after turning himself into police. He was arraigned Friday in Riverhead Justice Court on a second-degree assault charge and released on his own recognizance.
Cheshire and his attorney could not be immediately reached for comment.
The suspected burglar, who police did not identify, suffered non-life-threatening injuries and will be charged at a later date, police said.
