A man accused of a ruthless 2008 killing is likely to face a new trial, after jurors failed to reach a verdict after about five days of deliberations.

Lawyers said Tuesday that Olban Gonzales, 21, of Roosevelt, probably will be retried on murder and attempted murder charges in the coming months.

Prosecutors have said Gonzales and another man, who had a long-standing grudge against the MS-13 gang, shot four men they mistook for their rivals "like fish in a fishbowl" as they sat in a Honda Civic outside the La Boom nightclub in Westbury.

One of the men, Edwin Mejia Alvarado, 17, of Westbury, died in the attack. The other three men in the car were injured, prosecutors said.

The second man accused in the shooting, Dwayne Dailey, 23, was convicted and is serving 100 years to life in prison.

Carole Trottere, a spokeswoman for Nassau District Attorney Kathleen Rice, said the case against Gonzales is solid.

"The evidence is strong in this case and we look forward to presenting it to another jury as soon as possible," she said.

But Gonzales' lawyer, Michele Armstrong, said that while her client was nearby when the shooting occurred, he didn't do it.

"I believe there was reasonable doubt, and hopefully I can convince the next jury of that," she said.
