A St. James man was charged in upstate Tuxedo with driving while intoxicated with two children in his car, State Police said Friday.
Mauricio Chalpeno, 41, was charged with a felony under Leandra’s Law, which increases penalties for DWI with children in the vehicle, police said.
Chalpeno was stopped for “multiple traffic violations” about 10 p.m. Tuesday and a subsequent test showed a blood alcohol content of 0.13 percent, police said. The threshold for drunken driving is 0.08 percent.
Bail was set at $1,000 cash or $3,000 bond, and Chalpeno was released Wednesday after it was posted, the Orange County jail said.
The children were turned over to a responsible party, police said.
