A woman from Ukraine, tricked by the FBI into returning to the United States, has pleaded guilty to producing and sending child pornography to a Smithtown real estate investor previously convicted on related charges, officials said Tuesday.

Olena Kalichenko, 29, of Kiev, pleaded guilty late Friday to a five-count indictment in a Brooklyn federal courtroom to charges, including conspiracy to sexually exploit a child, sexual exploitation of a child, transportation of child pornography, and producing sexually explicit pictures of a minor for importation into the United States, said Eastern District spokeswoman Nellin McIntosh.

Kalichenko sent photographs of a 3-year-old girl involved in pornography to the investor, Joseph Valerio, 49, her boyfriend when she lived in the United States, officials said.

Valerio, who is awaiting sentencing, was convicted in November 2014 in federal court in Central Islip, in a 15-count indictment of charges related to the child pornography involving the 3-year-old as well as a 6-year-old Smithtown girl. Kalichenko was not accused of involvement in the case of the Smithtown girl.

An FBI agent lured Kalichenko to the United States by telling the woman she would be able to testify against Valerio, but withholding from her that she might also be charged in the case. She borrowed money to pay for the plane ticket from Kiev to the United States, sources familiar with the case said.

Kalichenko was arrested by FBI agents and Suffolk detectives, who worked jointly on the case, when she returned to the United States in July 2015. She has remained in custody as a flight risk because no extradition treaty exists between Ukraine and the United States, officials have said.

Her trial was set for last Friday in Central Islip federal court but she broke down in tears after viewing some of the images of the 3-year-old and insisted on pleading guilty, according to sources. The child is living with a relative in Ukraine, the sources said.

Kalichenko’s attorney, Robert LaRusso, of Mineola, said Tuesday his client “has accepted responsibility for what she had done.”

Eastern District prosecutor Ameet Kabrawala declined to comment.

Kalichenko told the agent in Kiev she made the pornography at Valerio’s request. He had sent her as much as $12,000 but threatened to stop sending money if she did not continue to send the child pornography.

Both Kalichenko and Valerio face a mandatory minimum of 15 years in prison when they are sentenced, officials said. But they could face a much higher sentence under federal sentencing guidelines.
