A West Hempstead man was arrested Tuesday night, one month after he illegally dumped garbage at a construction site in Massapequa, Nassau County police said.

Detectives located Benny Baez, 34, about 11:30 p.m. Tuesday at his home on Mary Ann Lane, and said that he “did flail his arms” and ran out a side door of the home — in order to avoid being taken into custody. Baez was eventually subdued and was charged with petty larceny, criminal tampering and resisting arrest, police said. He is scheduled for arraignment Wednesday in First District Court in Hempstead.

Police said that on March 5, Baez illegally dumped garbage at the construction site on Clocks Boulevard.

It was not immediately clear what type of refuse — or how much — was dumped at the site.

It also was not clear how police identified Baez as a suspect or why it took the agency a month to arrest him.
