A federal court has canceled a hearing set for Wednesday for the Billy Dean's strip club lawsuit against the Town of Hempstead.

William Stephen Dean and his company Green 2009 Inc. sued the town in August as town officials attempted to block Dean from opening a cabaret in Wantagh.

Dean filed for a permit in 2011 to open a Las Vegas-style cabaret with live music and dancers. The town has denied his permits for the project, citing noise concerns for residents living off Sunrise Highway.

The civil rights lawsuit accused the town of violating Dean's freedom of speech and preventing the club from opening at 3500 Sunrise Hwy.

Attorneys for both parties agreed Monday to cancel Wednesday's scheduling conference.

The final pretrial conference was set for 11:30 a.m. June 16 at the Eastern District Federal Court in Central Islip.
