A Massapequa man was arrested in Amityville early Sunday after he was found driving while intoxicated with his teenage son in the car, Suffolk County police said.

Police said an officer saw Jairo Penate-Cruz, 34, run a red light at Broadway Avenue and Oak Street just after 4 a.m.

The officer stopped Penate-Cruz's 2009 Toyota and found he was intoxicated, police said. The man's 15-year-old son also was in the car, according to police.

Penate-Cruz was arrested and charged with aggravated driving while intoxicated with a child passenger 15 years old or younger, also known as Leandra's Law, a felony; driving while intoxicated; and endangering the welfare of a child. Police said the teenager was released to his mother.

Penate-Cruz was scheduled to be arraigned Sunday at First District Court in Central Islip.
