Restaurant & Caterers per proposals returned Jan. 8, and authorized the supervisor to sign an agreement on a form approved by the town attorney.

After due study, issued a SEQRA negative declaration, determination of nonsignificance (EIS not necessary), in the matter of the application of PetSmart waiver request by PL Smithtown, LLC, for the reasons stated

in a memorandum from Howard Barton III, assistant environmental protection director, dated

Nov. 23.

After due study, issued a SEQRA negative declaration, determination of nonsignificance (EIS not necessary), in the matter of the application of Broadley Avenue Development Co., LLC (09-15), for reasons stated in a memorandum from Barton dated Jan. 11.

After due study, issued a SEQRA negative declaration, determination of nonsignificance (EIS not necessary), in the matter of the application of David Swift for Smithtown Nissan (09-22), for reasons stated in a memorandum from Barton dated Jan. 11.

After due study, issued a SEQRA Negative Declaration, determination of nonsignificance (EIS not necessary), in the matter of the application of Jasali 645 Realty, LLC, for Smithtown Acura (09-26), for reasons stated in a memorandum from Barton dated Jan. 11.
