ACTIONS

At its April 6 meeting, the town board:

Adopted a proposal from L.K. McLean Associates, P.C., for professional services in connection with the preparation of the 2009 Town of Smithtown Financial Assurance document as required by the New York State Department of Environmental Conservation for the municipal services facility closed landfill areas at an annual cost not to exceed $7,500 and authorized the supervisor to execute an agreement on a form approved by the town attorney.

Adopted that activity proposed by Hawkins Webb Jaeger on behalf of Arthur Krantz in the Marine Law Permit Application CBML 2008-2, located on Suffolk County Tax Map parcel 801-2-1-19.3, does not violate the provisions of Section 138-14 of the Code of the Town of Smithtown, and approved the application subject to the conditions as recommended in a memorandum dated March 26 by Russell K. Barnett, environmental protection director, and directed the town clerk to issue the requisite permit.

Issued a written consistency determination pursuant to Chapter 151 of the Town Code, that Application 10-05 Brigitte Adamo is consistent with the LWRP subject to conditions stated in the March 23 memorandum from

the planning director.

Issued a written consistency determination pursuant to Chapter 151 of the Town Code, that Application 10-03 (Land Ventures Residential Communities, Ltd.) is consistent with the LWRP subject to conditions stated in the March 30 memorandum from the planning director.

Authorized the comptroller to execute a transfer from account A.1990.0900 (contingency) in the amount of $35,000 to account A.1315.0150 (accruals) in the amount of $35,000.
