Calling all visionaries. A <a href="/topics/Long_Island%2C_NY">Long Island</a> contest is looking for a few good envelope-pushing ideas. 
A <a href="/topics/Garden_City%2C_NY">Garden City</a> group Wednesday announced a "Build a Better Burb" contest, with a top prize of $10,000 for the winning idea on how to re-imagine and reinvigorate <a href="/topics/Long_Island%2C_NY">Long Island</a>'s aging downtowns. 
The Long Island Index People's Choice Award creators said they seek "bold new ideas" on "creatively retrofitting or redeveloping existing downtowns" that can be about a particular downtown or a "prototypical" one. 
"Hopefully we get some crazy ideas, too," said Nancy Rauch Douzinas, president of the Rauch Foundation and publisher of the Index. The contest would look for doable proposals but, "whenever there are breakthroughs, you have to push the envelope." 
The new competition hopes to attract entries from planners, architects, urban designers, students, engineers and "visionaries" everywhere who are capable of meeting the contest's guidelines. They'll have until June 21 to register at buildabetterburb.org. 
A blue-ribbon panel will select at least 20 finalists by July 6, when the public can begin to vote on winners to be announced in September. A $2,500 prize will go to the top student entry. There is no fee to compete. 
"There should be no preconceptions about what is or is not possible," competition adviser and "Retrofitting Suburbia" co-author June Williamson said in a prepared statement. 
"What would you do in these acres of opportunity?" said Williamson, an associate professor of architecture at <a href="/topics/City_College_of_New_York">City College of New York</a>. "Build a car-free community for thousands? Plant an oasis of urban agriculture? Produce renewable energy and provide well-paying green jobs? The possibilities are endless." 
Douzinas said the contest is modeled on similar ones held elsewhere and was a good way of "bringing some of the best professional thinking about design and suburban change and development to Long Island." 
The Long Island Index marshals the research of experts and polling to produce an annual report about Long Island life. Its 2010 "Places to Grow" report found that many acres are available for development in downtowns.

In a push to revive <a href="/topics/Long_Island%2C_NY">Long Island</a>'s downtowns and increase local tax bases, village and town officials increasingly are using the power of eminent domain to seize private properties from homeowners and small business owners to pave the way for developers to build retail, housing and other private projects. 
The trend - noted by local planners, developers and officials as well as a national legal advocacy group that has studied eminent domain - picked up steam in the wake of a controversial U.S. Supreme Court decision in 2005 that upheld a government's right to seize private property for private development. 
In at least 10 ongoing cases - from Hempstead to <a href="/topics/Babylon%2C_NY">Babylon</a> to <a href="/topics/Patchogue%2C_NY">Patchogue</a> - local officials have condemned or threatened to condemn private properties for sale to developers who would build such projects as a supermarket, a hotel, condos and office buildings. 
The aim, these officials say, is to eradicate blight, create jobs, spur economic activity and bring in more tax dollars. 
While municipalities have long used eminent domain to seize land for public projects, turning property over to private developers has spurred criticism from those who equate that to a land grab. 
"To muscle a person into selling their structure - a home, a business, whatever it might be - is wrong," said Jay Oberlender, 44, who is suing Hempstead to prevent the town from forcing him to sell his <a href="/topics/Elmont%2C_NY">Elmont</a> property, which is home to six businesses. The town wants the land for a developer to build a supermarket. 
Planners, officials and builders, however, said negotiations between owners and developers to purchase land don't always work and eminent domain is necessary for progress. 
"It can be a useful tool to get to the finish line," said <a href="/topics/Michael_White">Michael White</a>, executive director of the <a href="/topics/Long_Island%2C_NY">Long Island</a> Regional Planning Council. 
Under both the New York State and United States constitutions, the government has the power to take an individual's private property provided the action meets two important criteria: It must be for a public use and just compensation must be paid.

'Public projects' expanding 
Historically, governments have seized private land to build public projects such as highways, bridges, hospitals, schools and parks. The definition of public use has expanded: The 2005 Supreme Court decision, Kelo v. The City of New London, upheld by a narrow 5-4 vote the government's right to use eminent domain for economic development. 
In reaction, 43 states passed laws restricting the government's power to seize private property for private development. New York was not among them. 
"Merely to say we can get more taxes by taking Mr. Jones' property and selling it to Mr. Smith is certainly not an appropriate use of eminent domain, regardless of what the U.S. Supreme Court says," said Lee Koppelman, director of the Center for Regional Policy Studies at <a href="/topics/Stony_Brook_University">Stony Brook University</a> and former executive director of the <a href="/topics/Long_Island%2C_NY">Long Island</a> Regional Planning Council. 
From 1998-2002, there were 146 known properties in New York State that were condemned or under threat of being taken over by local governments, according to a report issued by the Institute for Justice, a public interest law firm based in Arlington, Va. One year after the Kelo decision, that number jumped fivefold, to 734. 
The report referred to New York as the "perhaps the worst state in the nation when it comes to eminent domain abuse." 
"I think in some municipalities, the Kelo decision did make it easier to take land," said <a href="/topics/Westbury%2C_NY">Westbury</a> village Mayor Peter Cavallaro. "It probably opened their eyes to it as a more viable option."

At issue in Hempstead 
In Hempstead, town officials have announced plans to seize private property if necessary for private development in projects in <a href="/topics/Elmont%2C_NY">Elmont</a> and <a href="/topics/Baldwin%2C_NY">Baldwin</a>, and threatened to use eminent domain before the owner of the Courtesy Hotel in <a href="/topics/West_Hempstead%2C_NY">West Hempstead</a> sold the building to a developer. 
<a href="/topics/Eminent_Domain">Eminent domain</a>, Hempstead supervisor <a href="/topics/Kate_Murray">Kate Murray</a> said, is a "last resort" move to abolish blight. "It is a tool but it is very much the last tool we would ever want to use," she said. 
A $2-billion, mixed-use housing/retail project that might require the condemnation of 53 properties in the Village of Hempstead is expected to be revived this year. 
<a href="/topics/Patchogue%2C_NY">Patchogue</a>, which used eminent domain to complete two projects, is prepared to use that power again for a $130-million project in its downtown that would include a hotel and 240 rental units. 
"You do it very cautiously. It's an invasion," <a href="/topics/Patchogue%2C_NY">Patchogue</a> Mayor Paul Pontieri Jr. said. But, he noted, "Part of what we do is protect. Blighted buildings do nothing for the community." 
In one completed project, the Copper Beech affordable housing development finished in 2007, the last obstacle was the Victorian house of George and Claudia DeFilippo. The couple didn't want to see their two-story home demolished as had others that had been tagged for condemnation and then sold. So they worked out a deal with village officials and the developer to have the 113-year-old house moved two blocks away. 
Though the DeFilippos were happy in the end, their son Leonard said, he opposes eminent domain being used in that way. 
"I still have this feeling that they're taking from the small guys so the big guys can make money, especially for development," Leonard DeFilippo said. "I'm so very, very much against that." 
So are Oberlender and Tess Mittman, owner of the Argo Theatre that houses several businesses in <a href="/topics/Elmont%2C_NY">Elmont</a>. The pair is suing Hempstead Town for designating their properties as blighted, the first step in the condemnation process the town hopes leads to the building of a supermarket.

Dispute over 'blight' 
Oberlender said he doesn't understand how Hempstead can declare his property blighted when there are six tenants operating there - a dental office, hair salon, printing shop, dry cleaner, real estate office and tax preparation service. 
His property generates close to $65,000 in annual town and school property taxes, he said. 
"I believe redevelopment, in and of itself, is a good thing," said Oberlender, who has owned his property for 11 years. "The question is the way they're going about it." 
In Riverhead, town officials who took office in January pulled the plug on a proposed $120-million urban renewal project that called for the town to condemn 11 private parcels. 
New Supervisor Sean Walter, who touted his opposition to eminent domain during the campaign, said he and the town board will work to encourage development - without using eminent domain. 
"I don't believe it's the government's function to take one person's private property and give it to a developer for private use," Walter said. "It may be legal that you can do it, but it's really not proper."

Over intense objections from property and business owners, the <a href="/topics/Hempstead%2C_NY">Hempstead</a> Town Board Tuesday adopted an urban renewal plan for Elmont that would uproot 23 businesses and force their landowners to sell to a developer who would build a supermarket. 
Supervisor Kate Murray and the six council members voted unanimously to move forward with the redevelopment of the former Argo Movie Theater and adjacent properties in Elmont's business corridor, a stone's throw from <a href="/topics/Belmont_Park_Race_Track">Belmont Park racetrack</a>. 
Town officials said they will use the power of eminent domain to seize the properties if the four owners and the developer, yet to be named, are unable to reach deals on their own. 
At Tuesday's public hearing, all four property owners urged officials to consider an alternate site, raising a host of objections from economic hardship to fairness. 
Three of the owners expressed outrage that in a free country, the government could force them to sell their land to a private developer. That only happens, they said, in a Socialist or Communist country. 
"It sounds like I am living in <a href="/topics/China">China</a>," said Lawrence Liu, one of the property owners. 
Edward Ambrosino, the councilman who represents Elmont, said residents and civic leaders met over the years to discuss ways to revitalize the community and concluded there's a need for a full-service supermarket. 
The properties at <a href="/topics/Hempstead%2C_NY">Hempstead</a> Turnpike and Elmont Road, when combined with an adjacent town-owned parking lot, could accommodate a 40,000-square-foot supermarket, Ambrosino said. 
"We have an obligation to try to address the needs of our constituents," he said after the meeting. Years ago, <a href="/topics/Hempstead%2C_NY">Hempstead</a> used eminent domain to acquire properties west of the Argo as part a plan to build affordable homes, Ambrosino said. Today, the site, totaling about 25,000 square feet, remains empty. 
Under urban renewal, Hempstead is permitted to use eminent domain to seize properties that the town deems blighted or underutilized, said Eliot Bloom, special counsel hired by the town's Planning Department for the Elmont project. 
Two developers, Darcon Construction of Elmont and Mattone Group of <a href="/topics/Queens%2C_NY">Queens</a>, have submitted proposals to build a supermarket, Bloom said. 
The planning department expects to recommend one of the developers to the town board in a month or two, Bloom said. The developer would then meet with the landowners to negotiate the sale. 
Tess Mittman, who owns the former Argo Movie Theater, and Jay Oberlender, another property owner, are suing the town to stop the sale. 
If underutilized property is a yardstick town officials use to seize private land, Oberlender said, then all property owners should be alarmed.

Town's renewal plan to uproot Elmont businesses

Mario Cavalluzzo settled in <a href="/topics/Elmont%2C_NY">Elmont</a> 49 years ago after immigrating from Italy. 
He worked hard and more than a decade ago bought a small piece of property in <a href="/topics/Elmont%2C_NY">Elmont</a> that he rents out to several businesses. 
Cavalluzzo, 73, is angry that Hempstead Town might use eminent domain to force him to sell the land on Hempstead Turnpike so a developer can build a supermarket. 
Town officials want Cavalluzzo and 22 other property owners to make room for the private project. 
"They are going to rob the land from us. How is that fair?" said Cavalluzzo. 
Town officials have declared Cavalluzzo's land a blight, the first step in the condemnation process. 
Cavalluzzo, who pays close to $90,000 a year in property taxes, disagrees with that assessment, noting that his property has four businesses operating on it and a fifth expected to open in the spring. "We don't have empty stores. How can they justify it?" he said. 
Property owners are not the only ones affected by eminent domain. 
Frantz Sylvain leases one of the businesses on Cavalluzzo's property and has worked for more than two years to turn it into an upscale club with a restaurant and bar. 
Under eminent domain, town spokesman Mike Deery said, Hempstead would pay relocation expenses for business owners like Sylvain. However, if landlords and the developer reach private deals - avoiding the need for condemnation - Sylvain might be out of luck. 
Sylvain said he has invested $800,000 so far - including $200,000 from a second mortgage on his home and $300,000 borrowed from his brother - and expects to open the club in about two months. "What am I going to do?" he said. "I have to finish it."

Property, business owners feel threatened

Burned-out, boarded-up buildings give way to attractive retail stores and apartments. 
A high-speed thoroughfare is transformed into a leisurely Main Street, USA, with shops and pedestrian crossings. 
Empty garbage-strewn lots revived as European-style plazas, including fountains, art and space for outdoor concerts, ice skating and a farmers' market. 
The visions are just a few parts of Wyandanch Rising, the Town of <a href="/topics/Babylon%2C_NY">Babylon</a>'s extensive redevelopment initiative for downtown Wyandanch. 
The revitalization plan is one of Long <a href="/topics/Long_Island">Island</a>'s most ambitious: more than 60 acres at an estimated cost of $500 million, much of which the town says will come from private development. 
Supervisor Steve Bellone, who has championed Wyandanch redevelopment since taking office in 2002, calls the initiative a "comprehensive, community-based approach" that is "not just about building, but about changing lives." 
From the 1920s to the 1970s, Wyandanch thrived as a diverse community with a vibrant downtown. But it fell into disrepair during the crack epidemic, and rising crime rates drove out many families.

An incongruent mix Downtown Wyandanch now is an incongruent mix of single-family homes, small businesses and blighted, vacant commercial buildings and residences. Government officials and suburban planners consider it to be one of the Island's most economically distressed communities. 
Years in the planning, Wyandanch Rising targets seven areas and lists 76 residential and commercial properties with a total market value of more than $40 million on a map of "eminent domain appropriation areas/lots." 
The project has been embraced by many in and outside the community, though some downtown property owners are wary of being swept out by redevelopment. 
The plan will begin to take shape in the coming months, most notably with the expected start by this summer of construction on a long-awaited sewer line connecting to downtown businesses - an essential element of any redevelopment. 
Key parts to come later: mixed-use buildings with apartments above businesses, an <a href="/topics/LIRR">LIRR</a> station addition to accommodate car, bus and bicycle users, called an "intermodal" facility, and the narrowing of Straight Path to slow down traffic. 
The goal, Bellone said, is to create an attractive, functioning downtown that will spur private sector economic development. 
"Without us stepping in in a way to really facilitate the revitalization, the private sector will not, because of the circumstances in the community, make the investments necessary to revitalize," he said. 
Those circumstances include a crime problem - most notably, seven murders from Jan. 1, 2008 through Nov. 30, 2009. Suffolk Legis. DuWayne Gregory (D-Amityville), who represents the area, cited another shooting last week and said, "The problems continue to exist and they need to be addressed . . . The town is doing a wonderful job with the Wyandanch Rising initiative. Unfortunately, people's perception of crime in the community may have a negative impact on how successful the plan is." 
Other obstacles have been the dangerous Straight Path (324 reported crashes over the same period) and dismal tax rolls because of undeveloped parcels. 
Bellone estimates the redevelopment will create 3,000 construction jobs, 825 permanent jobs, $6.7 million in sales tax and $6 million in property tax revenue annually. Right now, the town estimates there are 50 to 75 permanent jobs and $800,000 a year in property tax revenue.&nbsp; 
Financing far from clear Bellone acknowledges it's not clear how the town will pay for much of the $500-million price tag. For the $18-million sewer project, the town has committed $6 million from its solid waste fund and last week received a $2-million state grant. 
For the $45-million intermodal facility, the town has pledged to bond for $15 million, money Bellone said will be recouped from parking revenue, and is applying for federal grants for the rest. Bellone said he is "optimistic that when we're ready to put the shovel in the ground, we'll have that money." <a href="/topics/Babylon%2C_NY">Babylon</a> has received nearly $7.5 million in grants used for planning. 
Wyandanch Rising has support from officials ranging from Sen. Charles Schumer to Gov. David A. Paterson to Suffolk County Executive Steve Levy, and the area was named one of three "spotlight" communities statewide for a new initiative to support redevelopment of 250 brownfield sites. That support signals a good chance of success, experts said. 
"You can't just talk revitalization into happening," said Lee Koppelman, director of the Center for Regional Policy Studies at <a href="/topics/Stony_Brook_University">Stony Brook University</a>. "There's got to be strong political forces that want it to happen . . . I see a climate there that didn't exist for many, many years." 
Last week, the town reached a tentative deal with <a href="/topics/Maryland">Maryland</a>-based design firm Torti Gallas to create a more concrete vision of the redevelopment. 
Bidding for the sewer contract should begin in March, Bellone said, with construction to start by summer. "We've been consistently moving the ball forward, moving the ball forward, and we're at the point now where we can actually see, OK, we're moving toward a development stage." 
Many in the community enthusiastically support the initiative. Belinda Marquis, 55, a pediatrician with an office on Straight Path, said she was skeptical at first but Bellone "has come through on a lot of things he said he'd do" - including beautification efforts, a new clock, a new post office and a resource help center. Some said they appreciate officials including the community in planning. 
"This is giving us an opportunity to grow with it and participate and this is important, especially for the next generation," said resident Sonia Wade, 55. 
Others criticize what they say is a sluggish pace, vague plans for homes and businesses, and poor communication. 
"People have the opinion that they want to see more than beautification," said Marquis' husband, Hilary, a local business owner and member of a community committee offering input on the plan. "They want to see something concrete and how it translates into dollars and cents for their business." He said some owners are unhappy because they expected the town to offer more help through relocation assistance, refinancing and loans. 
"We're not interested in trying to put anyone out of business," Bellone said. "Anyone who has a legitimate business in the community, we're going to want to help and support them."&nbsp; 
'Taking Map' makes a stir Reg Mays, owner of Computer Business Center, said he read all 187 pages of the town's plan, approved in May, after learning recently from a Newsday reporter that the address of his business was on the town's "Taking Map" of eminent-domain appropriations. 
After Mays and other Merritt Avenue owners whose properties were listed approached the town, a <a href="/topics/Babylon%2C_NY">Babylon</a> employee told Mays his property would not be acquired. "Obviously, this guy hadn't read the 187-page report," Mays said. "It clearly states what they intend to do, so don't tell me this is not what it is." 
Bellone said the town is "not even remotely thinking about acquisitions" of the Merritt Avenue properties whose owners approached the town. The properties are on the map because they are potential sites for redevelopment, he said, if the private sector is interested. 
"Not everyone in the redevelopment zone is targeted for acquisition," he said. 
Bellone declined to say which or how many of the 76 sites the town will pursue. So far, <a href="/topics/Babylon%2C_NY">Babylon</a> has acquired 19 properties - one of which was not on the map - for $15.5 million. Four were taken through eminent domain, for $4.2 million, the town said, with money from federal stimulus funds and bonds not yet issued. The 19 are the majority of planned acquisitions, the town said. 
Homero Peña said he's not convinced the town has no interest in the Merritt Avenue property where his Railroad Deli &amp; Grocery sits. Peña was trying to sell his business but uncertainty over the redevelopment caused the potential buyers to become anxious about signing a long-term lease. They recently backed out, he said. 
Many downtown business owners said they have not received redevelopment information from <a href="/topics/Babylon%2C_NY">Babylon</a> and that rumors run rampant. 
"Nobody has approached me," said Mark Demopoulos, owner of a wholesale ice cream business that has been in the downtown for 43 years. "I don't even know what to think about it. All of the businesses around here talk about it." 
Bellone said the town has had "extensive communications with people in the business community" in addition to mailing newsletters to residents and holding community meetings. 
The uncertainty extends beyond businesses. Rene and Ana Iraheta live on Grand Boulevard, among a mishmash of mostly dilapidated houses and businesses. But the Irahetas' home, which they've lived in for two years, is well-maintained. 
The couple hopes to remain there with their three children, two of whom are in Wyandanch schools. Worried about what they've heard in rumors, they became more fearful when they saw their property listed on the Taking Map. "I'm worried because I love my home," Rene Iraheta said.&nbsp; 
Homes to be condemned? Bellone said that only a handful of homes might be condemned in the redevelopment. "We certainly don't have any plans to condemn anybody's house," he said. "But if it were necessary for the town or a private developer to acquire a piece, then we'd negotiate with the owner and reach a fair price just like any other buyer would." 
Some residents remain skeptical about prospects for real change. They cite a history of politicians ignoring Wyandanch and past talk about redevelopment that never came to fruition. Bellone acknowledges this project will take more than a decade to complete but insists the initiative has broad-based support. 
"I wouldn't say that we've removed every ounce of doubt," he said. "[But] I think people have seen this is a real commitment and a real effort." 
Peña said he is willing to move if the town offers assistance but for now he is happy to remain in what he said is a good spot for business. "I don't want them to just push me out, I want to be in the community," he said. "I guess we'll just wait and see."
