<a href="/topics/Suffolk_County%2C_NY">Suffolk</a> County police said James D. Toner, 54, of 205 Sandpiper Lane in <a href="/topics/West_Babylon%2C_NY">West Babylon</a>, crashed his 2008 <a href="/topics/Mercedes-Benz">Mercedes-Benz</a> into their marked Crime Scene Unit van at the intersection of <a href="/topics/Montauk%2C_NY">Montauk</a> Highway and Bergen Avenue in <a href="/topics/West_Babylon%2C_NY">West Babylon</a> on Tuesday night. 
 The crash occurred at 10:11 p.m. 
 Police said an investigation determined Toner was drunk and he was charged with driving while intoxicated. He is scheduled for arraignment Wednesday in First District Court in <a href="/topics/Central_Islip%2C_NY">Central Islip</a>. 
 The officer, whose identity was not released, was taken to <a href="/topics/Good_Samaritan_Hospital">Good Samaritan Hospital</a> Medical Center in <a href="/topics/West_Islip%2C_NY">West Islip</a>, where he was treated for neck and back injuries and later released.
