Police: Queens woman drove drunk with kids in car
A Queens woman was arrested Monday night in Inwood, charged under the five-month-old Leandra's Law with jeopardizing the safety of her two children by driving drunk, Nassau County police said.
The children were 3 years old and 21 months, police said. The law makes it a felony to drive drunk with a child under age 15 in the vehicle.
Officers said Leticia Diaby, 44, of 107 156th St., Jamaica, was driving a 1996 Dodge van on Sheridan Boulevard near Baywater Boulevard when she was involved in an accident Monday at about 10:20 p.m.
Diaby left the scene but was stopped by witnesses at Sheridan Boulevard and Henry Street, police said.
When police arrived they found the two children were in the rear seat of the van. The 3-year-old was not secured in a child safety seat, police said.
Police said Diaby engaged in a brief struggle with officers before being arrested. She refused to take a breath test.
The children were released to the custody of their father, police said.
Diaby was charged with two counts of aggravated driving while intoxicated, resisting arrest, two counts of endangering the welfare of a child, driving while intoxicated, failure to secure a child under 4 in a safety seat, refusal to take a breath test and leaving the scene, police said.
She was scheduled for arraignment Tuesday in First District Court in Hempstead.
