Cuomo watch: Can an 80-year-old be a judge?

While he hasn't campaigned on the issue, Gov. Andrew M. Cuomo dislikes a proposal to raise the mandatory retirement age for judges from 70 to 80. He's reportedly questioned whether an 80-year-old should be a judge.

It's worth noting that if the constitutional amendment fails on Nov. 5, three of the seven judges currently on New York's highest court, the Court of Appeals, would have to retire in the next three years: Judges Robert Smith and Eugene Pigott Jr. and Chief Judge Jonathan Lippman.

Whoever wins the 2014 gubernatorial election would get to replace all three. Cuomo appointed two of the current members of the Court of Appeals: Jenny Rivera and Sheila Abdus-Salaam.-- Yancey Roy
