A last-minute Republican effort last week to scuttle the Women’s Equality ballot line in Suffolk County failed in court.

State Supreme Court Justice John Bivona ruled that Huntington Town Board member Susan Berland and about two dozen other Democrats qualified for the new ballot line created last year when it received 53,804 votes during the gubernatorial election.

Republican Elections Commissioner Nicholas LaLota went to court to force a new meeting of commissioners to determine whether the certificate of nominations for the Women’s Equality line was proper.

However, Bivona ruled that LaLota, in an earlier commissioners meeting, tried to alter the ballot but his motion failed in a split vote. Bivona ruled “there exists no rational basis” for a new meeting. The Suffolk GOP earlier also filed a lawsuit but later withdrew its challenge.
