The deadline for filing your tax returns is midnight Thursday, and thousands of Americans are busy crunching numbers in hopes of getting a tax refund. But experts warn that with frantic last-minute filing, you could make costly mistakes. 
Even a simple mistake such as forgetting to sign your return could result in your owing interest or penalties, said Beth Stetson,&nbsp; an assistant professor of accounting at <a href="/topics/Oklahoma_City">Oklahoma City</a> University. 
Stetson, who worked as an IRS attorney for nine years, has seen nearly every kind of mistake that can be made in filing tax returns. "If you make a mistake and you're audited, you can owe more tax, interest and penalties," she said. 
Here are some tips to avoid some of the most common mistakes that rushed people make when filing: 
1. Do make sure you understand your filing status. For example, she said, one woman she helped file qualified for head of household status because her disabled sister lived with her. 
When determining your status, remember that the term "child" can mean your biological children living with you. But "child" could also mean another person, such as a disabled relative or elderly parent. But Stetson warned that the term "child" can have different definitions when used to determine eligibility for earned income credits and child tax credits. So read those definitions carefully. 
2. Do use helpful Web sites such as IRS.gov or www.tax.state.ny.us, which offer valuable information for free. 
3. Do take advantage of free help if you qualify. IRS VITA (Volunteer Income Tax Assistance) program sites and <a href="/topics/AARP">AARP</a>'s Tax Counseling for the Elderly are two services that can help you file your taxes free of charge. 
4. Don't assume that just because you've received a Form 1099 that the income reported on that form is taxable. For example, if you received a state tax refund for 2008 in 2009, the state likely sent you a 1099, but the refund will not be taxable if you did not itemize deductions on your 2008 federal return. 
5. Don't make what Stetson calls "mechanical" mistakes. Be sure to sign your tax returns in the correct place (not in the preparer's slot), include all your W-2 forms, put proper postage on envelopes, include a check for taxes owed and be sure you put your forms in the right envelopes. 
6. Don't put your federal form in your state envelope and vice versa. "I've seen that happen once or twice, and then you're late in both places, technically," Stetson said. And, to avoid any late penalties, if you're filing late in the game, Stetson recommends sending your taxes via certified mail. 
7. Don't not file. Even if you owe money and you don't have the money to pay, it's much better to go ahead and file, then you can request some extension for time to pay," Stetson said. If you can pay in full within 120 days, the IRS may agree to a payment arrangement with no fee. 
You will still owe interest but may request a waiver of penalty. For longer time periods, for a fee you may be able to obtain an installment agreement. However, the IRS advises that you usually come out ahead if you can borrow funds from other sources to pay your tax liability.

DEAR OFFICE: I'm surprised your boss hasn't grown a Pinocchio nose, because the information isn't true, according to the IRS. 
"We are not aware of an IRS collection policy that says an employer cannot have an employee retirement plan while back taxes are owed," the spokesman said. 
Private retirement plans are covered, in part, by guidelines and laws in the Internal Revenue Code, which the IRS administers. Private retirement plans are also governed by the Employee Retirement Income Security Act, which is administered by the U.S. <a href="/topics/Labor_Department">Labor Department</a>. 
A <a href="/topics/Labor_Department">Labor Department</a> spokeswoman said the scenario you describe wouldn't prevent your company from setting up a retirement plan. So the ball is in your company's court.

DEAR CARRIE: After I lost my job, I applied for <a href="/topics/Unemployment">unemployment</a> benefits. To my surprise, I was initially denied benefits because the state <a href="/topics/Labor_Department">Labor Department</a> said it had no record of my employment. I thought perhaps the department didn't have my new address. So I called. 
Well, the state had no record of me because since 2005 my boss never forwarded to the IRS payroll taxes it took out of my check for such things as Medicare and Social Security and income taxes. 
After repeated calls to the department over two weeks, I established, via my W-2 statements, that I had worked, and I began to receive <a href="/topics/Unemployment">unemployment</a> benefits. And I notified the <a href="/topics/Internal_Revenue_Service">Internal Revenue Service</a> about what happened. My question is, how long can companies legally hold onto taxes after they deduct them from employees' pay? -- Vanishing Act 
DEAR VANISHING: The IRS has two schedules -- semiweekly and monthly -- for determining when the taxes deducted from employees checks have to be deposited. Companies choose a deposit schedule based on a tax liability reported earlier to the IRS. 
That's the simple version of a complex regulation. Your former employer should know about the schedule. DEAR READERS: A local accountant has responded with more advice for "Vanishing Act," the employee I wrote about two weeks ago who had trouble collecting <a href="/topics/Unemployment">unemployment</a> benefits because his boss deducted taxes from the worker's check but didn't forward them to the IRS. Because of that, the state <a href="/topics/Labor_Department">Labor Department</a> had no record of the employee and initially denied him benefits. He eventually established his work record through W-2s. 
The worker should also contact the <a href="/topics/Social_Security_Administration">Social Security Administration</a>, said Ruth Sattig Betz, a certified public accountant in <a href="/topics/Farmingdale%2C_NY">Farmingdale</a>. 
If the employer did not report or pay the payroll taxes, such as Social Security or Medicare, chances are the W-2 statements the worker received were never filed with Social Security, she said. 
"SSA records should be corrected, if necessary, because any omissions could affect the amount of Social Security 'Vanishing Act' collects in the future," she said.

DEAR CARRIE: I just started working in a sales position that pays me a salary plus commissions, or "bonuses," as my employer calls the extra pay. The company does not take out taxes from the bonuses and instead said we need to claim it on our taxes by filing a 1099 form. I would rather have taxes deducted so I don't have to deal with them later. Is this a normal process? -- Taxing Thoughts 
DEAR TAXING: You sound like an employee, but your company is treating you like an independent contractor regarding your bonus. Independent contractors file 1099 tax forms because they are responsible for paying their own income-related taxes, such as Social Security and Medicare. 
On the other hand, employers are responsible for deducting those taxes from employees' wages and including them on the workers' W-2 tax forms. And companies must also deduct the taxes from supplemental wages, a category that includes bonuses. 
The supplemental-wage category is broad. "They include, but are not limited to bonuses, commissions, overtime pay, payments for accumulated sick leave, severance pay, awards, prizes, back pay, retroactive pay increases, and payments for nondeductible moving expenses," the IRS says. 
The tax rate on the supplemental wage payments depends on such things as the size of the bonus, the employee's withholding allowances and whether the bonus payments are paid as a part of an employee's wages or separately, according to the IRS. 
So you're going to have to file the taxes your company didn't take out. Otherwise, the IRS will come calling. You must file IRS Form 8919 for uncollected Social Security taxes and Medicare taxes. 
Ask your company to take out those taxes. After all, it's the company's job. You know that now, and it's time the company did, too. Contact the IRS at 800-829-1040.

When should an employee file a 1099 form?

I owe the government some money. If I elect to start to receive my Social Security benefit, will I get the check, or will the <a href="/topics/Internal_Revenue_Service">Internal Revenue Service</a> take it to pay down my debt?-- SA via e-mail 
Dear SA: The IRS is one of the few creditors that can seize part of your Social Security benefit. Your benefit can also be garnished to cover unpaid child support and alimony, but that's about it. Not to worry, though. You're not even close to that calamity. 
First, a general word of reassurance. Social Security is protected from virtually all creditors, including credit card issuers, mortgage lenders, auto loan companies and collection agencies. 
In fact, it's illegal for creditors even to threaten that they may seize your Social Security benefits, says John Ventura, a bankruptcy attorney and the author of "Stop Debt Collectors" (2008, Credit.com), an extremely useful little book that offers a wealth of practical advice and provides sample letters to send to debt collectors, including one stating that your Social Security income is legally protected. 
Unpaid taxes are in a special category. The IRS has the option of levying up to 15 percent of a monthly Social Security benefit until your back taxes are paid. But that's a last resort and it doesn't happen without plenty of warning and a formal legal process. The <a href="/topics/Social_Security_Administration">Social Security Administration</a> garnishes benefits in response to a court order, says Jane Zanca, an agency spokeswoman: "We have to be notified that there's an appropriate levy. " 
You should contact the IRS and arrange to make monthly installment payments. Taxpayers who owe less than $25,000 can set up an installment agreement through an online application at irs.gov.

Filing on deadline? A primer on tax changes

If, in the frenzy of searching for tax documents, you come across a forgotten uncashed check or a rebate form you never sent in, you're not alone. 
Plenty of others report losing money as a result of paperwork clutter. Nearly 25 percent of 1,100 consumers polled said they had misplaced critical financial documents, with 16 percent saying they had lost money because of it, according to December research by the <a href="/topics/Consumer_Reports">Consumer Reports</a> National Research Center. 
"Only 16 percent?" said Jennifer Ryan, a professional organizer in <a href="/topics/Kings_Park%2C_NY">Kings Park</a>. Ryan said she can't think of a job on which "we didn't find money people didn't know they had." 
For April tax filers, the mission at hand is to make sure you don't forfeit deductions or credits on this year's taxes, so get those stacks into shape. 
Presort: Don't study every piece of paper. Instead, quickly group like items with like items, says Linda Goldfarb, a professional organizer in <a href="/topics/East_Meadow%2C_NY">East Meadow</a>. Make piles of credit card statements, bank statements, anything that says "important tax document inside." 
Further basics: Next, filter out only those documents related to 2009 taxes, says <a href="/topics/Shirley%2C_NY">Shirley</a> Feldman, a master tax adviser in the <a href="/topics/Hempstead%2C_NY">Hempstead</a> and Lake Success offices of <a href="/topics/H%26R_Block%2C_Inc.">H&amp;R Block</a>. She tells of clients coming in with boxes and bags of several years' worth of documents, and of a husband and wife, each of whom owned a business, who had to sort through a bag of "his" and "her" documents. 
Checklist: Once you file this year, lighten next year's load by creating a checklist. As related documents arrive, stuff them in one big envelope or folder marked "taxes." That's Feldman's parting gift to clients each year: a checklist and a nice big envelope.

Sort those tax papers so you don't lose money

If you think getting your taxes filed on time is stressful, how about this: filing on time when you owe Uncle Sam but don't have the money to pay. 
That's one reason the <a href="/topics/Internal_Revenue_Service">Internal Revenue Service</a> set up a special online page for the many people who are unemployed or otherwise unable to pay, with answers to questions as well as information on payment plans and installment agreements. Even if you file for an extension, you have to pony up what you owe by April 15 -- or make arrangements to do so. 
Yes, with such payment plans you'll incur interest, a penalty and often a processing fee, but that's still preferable to a route that Bill Hardekopf, chief executive of LowCards.com, says is pricier - using a credit card, which he says "should be avoided at all costs." 
Here are some options: 
IRS.gov: Under "individuals," look for the "tax center to assist unemployed taxpayers" link, where you'll find details on setting up a short-term agreement to pay within 120 days, or an installment agreement for a longer pay-back time, but higher expenses. For more help call 800-829-1040. 
Sell something: You still have time for an impromptu yard sale or online auction, says the Association of Independent Consumer Counseling Agencies, a group of nonprofit companies that offer credit advice and debt management services. 
Ask family: Your family network might come through with a loan, quite possibly interest-free, says Cesar Garcia, chief executive of Mayoria Global Inc., a financial education company in Melville. But don't expect a free ride. "Be responsible and pay it back ASAP," Garcia says. "Treat it as a business transaction between you and your family member."
