Patrick Garcia, former Senior Counsel in the Office of Counsel to the Inspector General, U.S. Department of Health and Human Services (HHS-OIG), has joined LeClairRyan’s Healthcare Regulatory, Transactions and Compliance team. He will be resident in the national law firm’s Annapolis office.
Garcia’s years of government experience add to the team’s existing wide breadth of services. While at HHS-OIG, he represented the government in a wide range of civil and administrative healthcare fraud enforcement matters in coordination with the Department of Justice, the Centers for Medicare & Medicaid Services, and the Food and Drug Administration. He drafted and negotiated civil settlements in numerous cases arising under the False Claims Act, Anti-Kickback Statute, Stark Law, Civil Monetary Penalties Law, and EMTALA. Additionally, Garcia represented HHS-OIG before the HHS Departmental Appeals Board in matters related to exclusion from participation in Federal health care programs, drafted and negotiated corporate integrity agreements, drafted and reviewed subpoenas, and advised agents and prosecutors conducting fraud investigations.
Garcia, who joined HHS-OIG in 2011, holds a J.D. degree, a Masters in Health Administration and a B.A. in Economics from the University of St. Louis.
The Healthcare Regulatory, Transactions and Compliance practice at LeClairRyan addresses the myriad issues affecting all segments of the healthcare industry, including group physician practices, community hospitals and health systems, academic medical centers, skilled nursing and long-term care facilities, urgent care facilities, home health companies, durable medical equipment suppliers, and clinical labs. They regularly provide clients with legal counsel and representation on compliance matters such as codes of conduct; conflicts of interest; financial arrangements with physicians; billing, coding and collection; compliance audits, including those related to Stark Law, Anti-Kickback Statute, False Claims Act, and, marketing, sales and promotional practices; provider enrollment and certification; reporting and voluntary disclosures under Medicare, Medicaid, and SCHIP; internal investigations and governmental fraud and abuse investigation.
In addition to its compliance resources, the Healthcare Regulatory, Transactions and Compliance team provides advice and representation on the operational and business issues hospitals face on a daily basis including, medical staffs bylaws and governance, credentialing, peer review and related hearings, corporate organization and governance, patient care and consent issues, risk management and liability issues, HIPAA and HITECH compliance, EMTALA matters, labor and employment issues, tax exemption issues including intermediate sanctions and private inurement, Joint Commission standards and Medicare Conditions of Participation, and medical malpractice defense.
LeClairRyan’s Healthcare Regulatory, Transactions and Compliance team also includes former government attorneys Lewis Morris and Kristin Bohl. Morris served as Chief Counsel to the OIG for ten years, during which time his office crafted compliance guidance for the health care industry, issued resource materials for health care boards of directors, and implemented the OIG self-disclosure protocol; which enables organizations to voluntarily disclose self-discovered evidence of potential fraud and avoid the costs and disruptions associated with a Government-directed investigation and litigation. Bohl served as Technical Advisor in the Division of Technical Payment Policy at the Centers for Medicare & Medicaid Services (CMS) where she focused primarily on issues related to the physician self-referral law (Stark). Bohl was part of the team that created and implemented the CMS Voluntary Self-Referral Disclosure Protocol, which enables entities to self-disclose actual or potential violations of the Stark law.
