Police: Lynbrook man drove drunk with 13-month-old son in backseat

A Lynbrook man violated Leandra's Law when he was driving drunk in Hempstead on Saturday night with his 13-month-old son in the backseat, Nassau police said.

According to police, Adrian N. Rubio, 27, of 12 Dawes Ave., was heading south on Clinton Street when an officer saw him driving erratically at 11:55 p.m. The officer stopped him on Front Street near Washington Street and discovered Rubio was intoxicated and had the boy in the backseat, police said.

Rubio was also driving with a suspended license, police said. He was arrested and the child was released to a family member at the scene.

Rubio is charged with aggravated driving while intoxicated under Leandra's Law, endangering the welfare of a child, driving while intoxicated, aggravated unlicensed operation of a vehicle in the third degree and traffic infractions.

Under Leandra's Law, driving drunk with a passenger age 15 or younger is a felony. The law was passed in 2009 after Leandra Rosado, 11, was killed in an DWI accident after the minivan in which she was a passenger crashed in Manhattan.

Rubio was arraigned Sunday at First District Court in Hempstead, where his bail was set at $5,000 bond or $2,500 cash, which had not been posted into the night. He is due back in court Tuesday.
