A Bay Shore man faces a charge of driving while intoxicated under Leandra's Law after troopers found him Sunday on the shoulder of the Southern State Parkway in Massapequa with an open beer, State Police said.

Michael Session, 27, of 63 Connecticut Ave., was parked in a black Acura on the eastbound shoulder near Exit 30, Broadway South, police said, when a trooper approached the car at about 3:32 a.m.

While speaking to Session, the trooper said he noticed a strong odor of alcohol and an open container of Heineken, according to a report. The trooper also noticed a child, later identified as Session's daughter, in the back seat of the car.

Session failed sobriety tests and recorded 0.14 percent on a breath-analyzer test, police said. He was arrested and charged with aggravated driving while intoxicated and several traffic violations.

He is being held and is scheduled to be arraigned at 1st District Court in Hempstead, police said.

His daughter was released to a family member and Child Protective Services was advised, police said. Her age was not released.

Under Leandra's Law, the aggravated driving charge is a felony. The law was passed after the death of Leandra Rosado, 11, who was killed in a DWI accident after the minivan in which she was a passenger crashed on the West Side Highway in Manhattan.

Also early Sunday, troopers arrested a Valley Stream man on a drunken driving charge after he was found parked the wrong way in the median on the eastbound Northern State Parkway in Albertson.

At 2:39 a.m., a trooper found Shawn Burgess, 35, of 84 Princeton St., parked in his Toyota Camry with its engine running near Exit 29, Roslyn Road, police said. The car was in the median, facing the wrong way, police said.

Burgess had a strong odor of alcohol and failed sobriety tests, police said. He provided a breath-analyzer reading of .10 percent and was arrested, police said.

He is charged with driving while intoxicated and is scheduled to appear Dec. 9 in 1st District Court in Hempstead, police said.
