A Glen Cove woman was arrested and charged with driving while intoxicated after her SUV, with her 5-year-old daughter as a passenger, collided with a home fuel tanker truck in Roslyn, police said.

The truck driver suffered nonlife threatening injuries when he was ejected from the vehicle after the Sunday night crash, police said. The truck's ruptured gas tank temporarily posed a threat to nearby buildings and residents, forcing the evacuation of five homes near the crash site, police said. There was no fire and no other injuries, officials said.

Nicole Lopez, 30, of 1335 Avalon Sq., was charged with aggravated driving while intoxicated, third-degree assault, endangering the welfare of a child and consuming alcohol in a motor vehicle, officials said.

Lopez was traveling north on Mineola Avenue near Old Northern Boulevard about 9:30 p.m. Sunday when she attempted to pass the fuel tank, Nassau police said. When her car struck the tanker, the driver's side door opened and the driver, 47, was ejected, police said. The tanker went off the road into a fence and began leaking fuel, police said.

Investigators found an open bottle of wine inside Lopez's car, police said. After a breath test, police said she was found to have a .23-percent alcohol level, nearly triple the legal limit of .08.

The child was placed in the custody of another family member, police said.

Lopez, held overnight, was released Monday on her own recognizance after arraignment in First District Court, Hempstead.
