A Massapequa woman was driving drunk with her 6-year-old daughter when she overturned her car after striking a parked car Monday afternoon in Massapequa, Nassau County police said.

Phyllis Lindberg, 49, of 77 Gem Lane, was arraigned Tuesday on felony drunken-driving charges under Leandra's Law after she drifted off eastbound Sunrise Highway near East Chestnut Street, hit an unoccupied parked car and overturned her car about 4:50 p.m., police said.

Both Lindberg and her daughter were taken to a hospital for neck and back pain, police said. The daughter was then released to her father.

Lindberg was arrested on charges of aggravated driving while intoxicated, a felony, and endangering the welfare of a child. At arraignment, her bail was set at $1,500 cash or bond. She is due in court Thursday.

Under Leandra's Law, passed in 2009, drivers who are suspected of being intoxicated or impaired by drugs with a child younger than 16 as a passenger can be charged with a felony. The law was passed after the death of Leandra Rosado, 11, who was killed in a DWI accident in Manhattan.

Nassau District Attorney spokesman Chris Munzing said Lindberg's blood alcohol level was not available.
