Man, 25, gets 1-year sentence in rape of 13-year-old girl

A 25-year-old man who authorities said met a 13-year-old on Facebook before having sex with her in a car in Glen Cove got a sentence Tuesday of one year behind bars.

Authorities said Tereso Ruiz-Hernandez, of Bayville, previously pleaded guilty to second-degree rape and criminal sexual act charges after his August arrest.

Police have said he lied to the victim about his age and gave her alcohol before raping her.

Nassau County Judge Angelo Delligatti told Ruiz-Hernandez he'd likely be deported after serving his concurrent one-year sentences.

He also granted a prosecutor's request to require Ruiz-Hernandez to register as a Level 2 sex offender upon release, and signed an order telling him to stay away from the victim.

Defense attorney Greg Madey had lobbied for a lower offender status for his client, saying Ruiz-Hernandez went on Facebook to meet girls, but "was just trying to date" and not seeking minors.

Madey said in court his client emigrated from El Salvador in 2005 before working as a busboy and living "pretty much hand to mouth."

The attorney said later he expected immigration officials to take Ruiz-Hernandez into custody shortly since he'd already served jail time covered by the sentence.

Nassau District Attorney Kathleen Rice said in a statement her office will keep prosecuting those targeting victims through social networks and educating young people on Internet dangers.
