Paterson pardons LI man in '05 shooting

A former Wyandanch man threatened with deportation after shooting to death a man who tried to enter his home in 2005 has been pardoned by Gov. David A. Paterson.

Sanjay Broomfield was charged with fourth-degree criminal possession of a weapon, a class-A misdemeanor, in the shooting more than five years ago. He was arrested after he shot to death a man he said was breaking into the Wyandanch home where he lived at the time.

Tyrell Rudolph, 20, of Wyandanch, was found in front of a home on Parkway Boulevard with gunshot wounds to his chest and left arm at 3:05 a.m. in February 2005.

Monday's pardon opens the path for Broomfield to receive residency status in the United States. He applied previously but had been rejected, according to the governor's office.

Broomfield's pardon was among six given to residents across the state who faced possible deportation because of previous criminal convictions.

"The pardons I grant today address shortcomings in our Federal immigration laws relating to deportation," Paterson said in a written statement. "Our review of more than 1,100 pardon applications reveals that Federal immigration laws are often inflexible, arbitrarily applied, and excessively harsh, resulting in the deportation of individuals who have paid the price for their crimes and are now making positive contributions to our society. These pardons represent an attempt to achieve fairness and justice for deserving individuals caught in the web of these laws."

Officials with the United States Citizenship and Immigration Service could not be reached for comment last night.

Broomfield, a baker at Entenmann's in Bay Shore at the time of the shooting, told police he fell asleep after working a double-shift.

He told police he shot Rudolph as he came through a window in his house.

Broomfield received 3 years probation for the shooting.
