Cops: Hampton Bays dad charged under Leandra's Law
A 37-year-old man was charged with felony driving while intoxicated under Leandra's Law after police said they caught him driving while intoxicated with his children in the car early Sunday in Hampton Bays.
Southampton Town police said the children, ages 4 and 11, were not injured and were released to the custody of a family member.
Their father, Francisco Franco, of Hampton Bays, was arrested and charged with aggravated DWI and with endangering the welfare of a child after a traffic stop on Montauk Highway at Gravel Hill Road about 1 a.m. Sunday. Police said officers stopped Franco after he failed to stop at a stop sign.
Arraignment details were not immediately available.
Leandra's Law is named for 11-year-old Leandra Rosado, who was fatally injured when a minivan driven by a friend's mother overturned on the Henry Hudson Parkway in 2009.
The driver, Carmen Huertas, was later convicted in the death.
The New York law makes it a felony, even on first offense, to drive drunk with a child under age 16 in the vehicle.
