Cops: No charges in fatal Bay Shore car crash

Suffolk police say alcohol appears not to have been a factor and that no charges are pending following a two-car crash in Bay Shore that killed one man and injured four others, including an emergency medical technician on his way to an accident.

Marlon Chavarria, 21, of Bay Shore, a volunteer EMT for Brentwood Legion Ambulance, had activated the lights and siren on one of their vehicles, a 2007 Ford Explorer, while driving west on Pine Aire Drive at about 11:30 p.m. Sunday, police said.

Chavarria was responding to a report of an overturned car on Pioneer Drive, police said.

He approached the rear of a 1993 Saturn SC, police said, which appeared to shift to the right, out of the Explorer's way. The Saturn then attempted a left turn on Cecil Avenue, police said, and the Explorer struck the driver's side of the Saturn.

A driver-side rear passenger in the Saturn, Daryn McKay, 18, of Bay Shore, was seriously injured and later pronounced dead at Southside Hospital, police said. Chavarria was taken to Southside Hospital with leg and shoulder injuries, which police said were not serious.

The driver of the Saturn, Jarred Smith, 18, of Brentwood, and two other passengers were taken to Good Samaritan Hospital Medical Center in West Islip with minor injuries.

A man who answered the telephone of a McKay relative said the family had no comment. A woman who answered the phone at Brentwood Legion Ambulance said neither she nor anybody else at the volunteer service could comment.

Det. Sgt. Bob Koerber said the official cause of the crash remains under investigation. Witnesses are asked to call the Third Squad at 631-854-8352 or Crime Stoppers at 800-220- TIPS.
