A Ronkonkoma woman violated Leandra's Law Thursday night in Commack by driving drunk and high with a 2-year-old boy as a passenger, State Police said.

Kerri Smith, 39, is charged with aggravated driving while intoxicated -- a felony -- driving under the influence of alcohol and drugs, endangering the welfare of a child and aggravated unlicensed operation of a motor vehicle.

She was scheduled to be arraigned Friday at First District Court in Central Islip.

A trooper from the Brentwood barracks saw Smith driving a Nissan Pathfinder at about 8:14 p.m. south on the Sunken Meadow State Parkway, just north of the Northern State Parkway, according to a news release.

The trooper noticed the vehicle swerving and pulled over Smith, the release said.

The trooper "detected the odor of an alcoholic beverage," police said, and Smith failed sobriety tests.

State Police did not disclose the relationship between Smith and the boy.

Under Leandra's Law, driving drunk with a passenger age 15 or younger is a felony. The law was passed in 2009 after Leandra Rosado, 11, was killed in an DWI accident after the minivan in which she was a passenger crashed in Manhattan.
