Cops: Speeder on Southern violated Leandra's Law
A Bay Shore man violated Leandra's Law Monday when he was driving high on the Southern State Parkway with his stepson as a passenger, State Police said.
Machardo Maxwell, 35, of 1072 Nugent Ave., was stopped for speeding on the parkway at about 9:26 p.m. when troopers noticed a strong odor of marijuana, according to a news release. Police did not specify the location of the motor vehicle stop.
Troopers also "observed signs of impairment," the release said, and Maxwell failed sobriety tests.
He was arrested and charged with aggravated DWI, a felony under Leandra's Law, endangering the welfare of a child, unlawful possession of marijuana, speeding, unlicensed operation of a motor vehicle and having an unregistered motor vehicle.
State Police also said the plates had been switched on the vehicle, a Chevrolet Tahoe.
Maxwell was scheduled to be arraigned Tuesday in First District Court in Central Islip.
Maxwell's 13-year-old stepson was a passenger, police said.
Leandra's Law was passed in 2009 after the death of Leandra Rosado, 11, who was killed in an DWI accident after the minivan in which she was a passenger crashed on the West Side Highway in Manhattan.
