A Flanders man faces drunken-driving charges under Leandra's Law after being pulled over early Tuesday for failing to stay in his lane, Southampton Town police said.

Cristobal Espinoza, 32, was driving on Flanders Road near Pleasure Drive in Flanders when police stopped him at about 12:10 a.m. Espinoza was intoxicated and had an 8-year-old child in the rear seat, police said.

He was arrested on charges of aggravated driving while intoxicated, a felony, and endangering the welfare of a child. He is scheduled to be arraigned Tuesday at Southampton Town Justice Court.

Police said the child was returned to his mother. Police did not reveal the relationship between Espinoza and the child in a news release.

Under Leandra's Law, passed in November 2009, drivers who are suspected of being intoxicated or impaired by drugs with a child younger than 16 in the vehicle can be charged with a felony. The law was passed after the death of Leandra Rosado, 11, who was killed in an DWI accident after the minivan in which she was a passenger crashed in Manhattan.
