Joseph Grucci of the famous fireworks family was sentenced Tuesday to time served -- five days -- for shooting his grandson twice in December.

The grandson, Christopher Giresi, 20, told Suffolk County Court Judge Gary Weber that he didn't want his grandfather to spend any more time in jail or on probation, and that he didn't want an order of protection, said Grucci's attorney, William Keahon of Islandia. Weber agreed.

"He said he wanted to live again with him," Keahon said. Giresi lived with Grucci, 70, in Bellport for at least a decade before the shooting.

Suffolk District Attorney Thomas Spota said he didn't have a problem with Giresi's request and Grucci's sentence.

Grucci has said he shot Giresi in self-defense after his grandson trashed the house after coming home drunk. Giresi had threatened to kill Grucci during an argument afterward, prosecutors said.

The shotgun blasts left pellets in Giresi's arm and torso. He was treated for the wounds but has recovered. Giresi has his own unrelated charges of drug possession and grand larceny pending in the same courthouse.

Grucci pleaded guilty in January to second-degree assault. He is the cousin of Felix Grucci, the former member of Congress and Brookhaven Town supervisor.
